Regulations of the electronic gift card.

for individual customers

Definitions

Publisher - KAJAKOWO S.C. Kucharski Arkadiusz, Kucharska Karolina with registered office in Zakrzówek Szlachecki 191,97-561 Ładzice, NIP 772-240-59-39;

Store - the Publisher's store located in Poland, operated under the name KAJAKOWO and the Internet store operated at www.KAJAKOWO.net

• The issuer shall only accept for execution Electronic Gift Cards the use of which is verified with the correct PIN number.
• For the Electronic Gift Card, it is necessary to verify the transaction by entering the PIN number in order for the user to purchase the goods in the stores of the issuer in exchange for payment with the card
• When the KAJAKOWO.net Electronic Gift Card is redeemed for Goods, the nominal value of the Card is reduced by the price payable to the Issuer for the Goods sold. The User shall not be entitled to receive change in cash if the value of the Goods received is lower than the current nominal value of the KAJAKOWO.net Electronic Gift Card
• In the event that the value of the purchased Goods is higher than the current nominal value of the KAJAKOWO.net Electronic Gift Card, the User shall pay the difference to the Issuer in cash or in another form of payment accepted at the Issuer's Stores, whereby the Issuer, for technical reasons, when shopping online

6. the User may use the KAJAKOWO.net Electronic Gift Card in combination with a bank transfer.

7. The user may use the KAJAKOWO.net Electronic Gift Card until the expiration date of the Card.

8. The issuer has the right to refuse to accept the KAJAKOWO.net Electronic Gift Card in case of
   1. expiration of the validity period of the KAJAKOWO.net Electronic Gift Card,
   2. -
   3. it is technically impossible to process the KAJAKOWO.net Electronic Gift Card (in particular it is impossible to connect to the issuer's computer system), provided, however, that in the case referred to in point c) the issuer will process the Card immediately after the hindrance specified in that point ceases to exist.
   4. if the Electronic Gift Card is inactive or blocked.
   5. failure to provide the correct PIN when using the Card in the online store KAJAKOWO.net
9. All operations performed on the KAJAKOWO.net Electronic Gift Card should be done only once.

IV. Type, activation of the KAJAKOWO.net Electronic Gift Cards

1. KAJAKOWO.net Electronic Gift Cards are bearer cards only. In the case of Cards used in transactions carried out in the KAJAKOWO.net internet shop the bearer of the Card shall be deemed to be the person who enters the 8 character code assigned to the Card and verifies the transaction with the correct PIN number assigned to the Card.
2. Activation of the KAJAKOWO.net Electronic Gift Card shall take place upon delivery of the Card by the Issuer to the Purchaser, unless the Issuer has agreed with the Purchaser that activation of the KAJAKOWO.net Electronic Gift Card shall take place at a later time (in any case no later than the first use of the Card)
3. The card will be delivered to the indicated e-mail address after payment for the card.
4. The card will be delivered within a maximum of 48 hours after payment for the card.
5. The card is prepared individually.
6. The KAJAKOWO.net Electronic Gift Card is valid and active for 12 (twelve) months from the date of activation.

V. Settlements and complaints of the KAJAKOWO.net Electronic Gift Cards

1. Upon issuing a KAJAKOWO.net Electronic Gift Card the Purchaser shall receive from the Issuer an accounting document confirming the purchase and the nominal value of the purchased KAJAKOWO.net Electronic Gift Card

3. The User is entitled to check the current nominal value and expiration date of the KAJAKOWO.net Electronic Gift Card. Checking the value can be done directly at the issuer's store, with the exception of the KAJAKOWO.net online store
4. Any complaints related to the use of the KAJAKOWO.net Electronic Gift Card at the issuer's store will be dealt with by the issuer within 14 (fourteen) days from the date the user submits the complaint
5. Complaints may be filed directly at the Issuer's stores, during their opening hours, by mail to the address of the office of the Issuer, with the annotation "Electronic Gift Card - complaint", or by email to the following address: kajakowo.net@gmail.com
6. Complaints regarding the purchased Goods can be filed under general rules.

VII. Final provisions

1. Before receiving the KAJAKOWO.net Electronic Gift Card the Purchaser shall receive these Terms and Conditions. By accepting the Electronic Gift Card KAJAKOWO.net the Purchaser declares that he/she is acquainted with the content of these Regulations, accepts them in their entirety and agrees to abide by their provisions. The purchaser, and each User of a KAJAKOWO.net Electronic Gift Card, is obliged to inform the next user to whom he or she passes the Card of the content of these Terms and Conditions, and in particular that: The Card can only be redeemed in the Stores of the Issuer, the Card is not refundable or exchangeable for cash, the Card expires on a certain date, and that the User can read the Terms and Conditions at www.kajakowo.net and in the Stores of the Issuer. Each User not being the Purchaser, by accepting the KAJAKOWO.net Electronic Gift Card declares that he or she is acquainted with the content of these Terms and Conditions, accepts them in their entirety and agrees to abide by their provisions.

2. The issuance of the KAJAKOWO.net Electronic Gift Card does not constitute sales subject to Value Added Tax (VAT) within the meaning of the applicable tax laws

3. The KAJAKOWO.net Electronic Gift Card is not an electronic payment instrument, nor is it an electronic payment card within the meaning of applicable laws. The KAJAKOWO.net Electronic Gift Card is a dematerialized, electronic form of a voucher
4. For all matters not regulated by these Regulations the provisions of the Civil Code shall apply
5. Content of these Regulations shall be delivered to the Purchaser together with the KAJAKOWO.net Electronic Gift Card and shall also be made available on the website at www.KAJAKOWO.net and in the Publisher's stores. The publisher is obligated to provide the user with these terms and conditions in writing upon request
6. The issuer reserves the right to amend these terms and conditions for the following important reasons: a change in law, new technologies and information systems requiring an amendment to the functioning of the KAJAKOWO.net Electronic Gift Card, a final court decision, an administrative decision, force majeure as defined by Polish civil law.
7. The Issuer shall also have the right to amend these Terms and Conditions at any time without giving reasons, with the proviso that such amendment shall not apply to KAJAKOWO.net Gift Cards issued up to the date of such amendment.
