REGULATIONS

The online store, operating at www.KAJAKOWO.net , is operated by Kucharski Arkadiusz NIP PL 772-208-37-89, based in Zakrzówek Szlachecki 215, 97-561 Ładzice, Łódzkie Province, Radomszczański District, Ładzice Municipality, Poland

  1. The Buyer places orders via the website www.kajakowo.net

  2. Before placing an order the Buyer is obliged to familiarize himself with the content of these Regulations.

  3. Placing an order by the Buyer means that the Buyer has read and accepts the content of these Regulations.

  4. Seller is entitled to withdraw from the contract in case of violation of these Regulations.

  5. All prices of goods listed on the Store's website are in Polish zloty and include VAT. Gross prices.

  6. Each shipment is accompanied by a receipt or invoice. In the case of buyers running a business, after providing the Seller with NIP number, the Seller will attach VAT invoice with NIP number.

  7. The Seller makes every effort to ensure that the content of the Online Store website as accurately as possible corresponds to reality. In case of possible discrepancies in prices, configuration or technical parameters - the Seller's employee will immediately inform the Buyer about it. In this case, in order to execute the order it is necessary for the Buyer to accept the price, configuration or technical parameters other than the original, obtained by e-mail. If the Buyer has accepted the new price and has already paid the original price, the condition for the execution of the order is the payment by the Buyer of the difference between the original price and the current price. In the case of non-acceptance, if the Buyer has paid for the ordered goods when placing the order or has paid the Seller a prepayment for the order placed, the Seller shall return to the Buyer the price paid.

  8. The condition for the realization of an order is to properly fill the order form, in particular to provide a phone number and e-mail address to confirm the order and consent to the use of the phone number and e-mail address indicated. The result of failure to comply with these obligations by the Buyer shall be inability to implement the order by the Seller.

  9. Due to the unavailability of the ordered goods at the Seller's, the lead time may be extended. Employee of the Seller within 7 days from placing an order will inform the Buyer (by phone or e-mail) of the nearest possible date for completion of the order. In this case, the order at the written request of the Buyer (sent by e-mail) can be canceled. The Buyer and the Seller may also agree via e-mail that due to this situation the subject of the order shall be a substitute product instead of the temporarily unavailable product.

  10. If one of the ordered goods is unavailable at the Seller's due to out-of-stock, and its value amounts to 0-15% of the total order - the order may be partially completed. Seller's employee shall inform the Buyer about the unavailability of the above goods and shall return to the Buyer the price paid for the unavailable goods. If the Buyer pays the price upon receipt of the goods (cash on delivery), the Seller shall deduct the price of the unavailable goods from the price of the original order.

  11. The accepted order is automatically confirmed by a return e-mail sent to the e-mail address provided in the placed order. After logging into the account on the Store's website, the Buyer can check the status of his order. The Seller proceeds to the fulfillment of the order after stating that the order form has been filled correctly, i.e. in a manner allowing the order to be processed.

  12. In justified cases the Seller may make the execution of the order conditional on prepayment to the Seller's bank account.

  13. The order processing time is from 1 to 30 working days counted from the date of order confirmation described in point 11 of these Terms and Conditions. The possibility of deviation from the above order processing time is provided in point 9 of these Terms and Conditions.

  14. In accordance with the Act on Protection of Certain Consumer Rights and Liability for Damage Caused by a Dangerous Product of 2 March 2000 (Journal of Laws of 2000, No. 22, item 271, as amended), the Consumer* has the right to withdraw from the contract, without giving reasons, making a statement in writing within 14 calendar days from the date of receipt of the subject of the order. In connection with the withdrawal from the contract the Consumer shall be obliged to return to the Seller the subject of the order in an unchanged condition. Return of the subject of the order shall be made immediately, but not later than within 14 (fourteen) days. The cost of delivery with the returned subject of the order shall be borne by the Consumer. Seller shall refund the payment to the bank account specified by the Consumer, after receiving from the Consumer a copy of the invoice

    *Article 22 of the Civil Code, states: [Concept of consumer] A consumer is a natural person making a legal transaction not directly related to his/her business or professional activity.

  15. The Administrator of Users' Personal Data is Kucharski Arkadiusz NIP 772-208-37-89, with registered office in Zakrzówek Szlachecki 215, 97-561 Ładzice, Łódzkie Province, Radomszczański County, Ładzice Municipality, Poland.
  16. The User in the process of registration as well as the unregistered User in the process of placing an order provides their personal data voluntarily.

  17. Shop owner Kayakowo.net processes User personal data in order to implement the User's order placed via the shop. Giving personal data by the user is voluntary, but nevertheless necessary to carry out the order. Owner of the store makes User personal data available to payment operators and courier companies only for the purpose of implementation of the order placed by the User
  18. Shop owner Kayakowo.net with a separate and voluntary consent of the user processes personal data of the user also for marketing purposes (sending newsletters).
  19. User has the right to supplement, update, correct, abandon processing, if they are incomplete, outdated, or false
  20. The User has the right to delete personal data or to object to its processing only when it is used for statistical or marketing purposes, or when it was not used to make a purchase. According to the law, data related to the purchase made cannot be deleted at the request of the User.

  21. By signing up to receive commercial information electronically (newsletter), the User agrees to receive commercial information within the meaning of the Act of 18 July 2002 on electronic services (consolidated text: Journal of Laws 2013, item 1422). The user may at any time resign from receiving commercial information electronically.

  22. In order to obtain information about their personal data, the request for their availability, or removal, User may contact the Administration of the shop kajakowo.net at the address: kajakowo.net@gmail.com.

  23. Ordered goods are delivered via courier company DHL, K-EX, UPS Poland Sp. z o.o. or large-volume courier, or courier Kajakowo (combined transport).

  24. Goods can be picked up in person, you should then contact the staff of the company.
  25. Shipments under the Rules are carried out only in the Republic of Poland. Conditions for delivery outside the country are discussed individually with the Buyer.

  26. Shipments larger than 2 meters are realized by combined transport or courier. The cost of such shipment is determined individually with the customer.

  27. The Seller reserves the right to make errors, and in this case the offer does not constitute an offer within the meaning of the Civil Code.

  28. By placing an order the Buyer accepts the above Rules of the Shop.
